Bryan Hayes and Mark Degner are Endangered Missing from Jacksonville, Florida. They have been missing since 2005. America’s Most Wanted has run stories about their disappearances.

Mark Anthony Degner and Brian Andrew Hayes were good friends. Classmates of the two boys said that they planned on running away, and it seems that that is exactly what happened. It’s been more than a year since the two boys disappeared. What happened to Mark Degner and Bryan Hayes?

Now Jacksonville Sheriff’s Office is asking what has happened to 12-year-old Tony Youmans? He went missing Sunday afternoon.

He does not have a history of running away and JSO has upgraded his case to Missing Endangered/ Foul Play Suspected.

A missing child alert was issued but he is not listed at the NCMEC or the Florida Department of Law Enforcement (FDLE) Missing Children Information Clearinghouse (MCIC). However there are 85 other missing children from Jacksonville, Florida a city with a population of approximately 800,000.

Update:

JACKSONVILLE, FL — Searchers have found a body in the woods not far from the home of where a boy missing since Sunday lived. Investigators wouldn’t say whether the body is that of 12-year-old Tony Youmans, or if the body is of a young person.

The discovery is along Hyde Park Road, about a block and a half from the boy’s home

Update 08-01-07   The police have not positively identified the body but it was described as wearing similar clothes to those of Tony. It is being reported by the Florida Times-Union the family, pesumably because it is the 1st of the month, has continued with previous plans and moved to Yulee, Fl. about 25 miles north of Jacksonville.

Note: Some are wondering why an Amber Alert was not issued. This is the criteria for the State of Florida.

 Criteria For Activation

To activate the AMBER alert the following five (5) criteria must be met.

  1. The child must be under 18 years of age. 

  2. There must be a clear indication of an abduction. 

  3. The law enforcement agency’s investigation must conclude that the child’s life is in danger. 

  4. There must be a detailed description of child and/or abductor/vehicle to broadcast to the public (photo when available). 

  5. The activation must be recommended by the local law enforcement agency of jurisdiction.

When a child goes missing, the reason why may not be immediately clear. It may not be in the case of an adult either but often times they are making their own choices.  Do you recall the story of the ministers wife who went “missing” after traveling to Shreveport, La., to attend a two-day women’s religious retreat.

Louisiana police located Mary Byrne Smith alive and well in New York state on Friday. The 30-year-old kindergarten teacher had been working under an assumed name at a fast-food restaurant.

Will this desensitize the public in other missing children or adult cases? There are currently 17 missing children in Alabama listed at the NCMEC. One of them is 6-year-old Amber Carlton , another 10-year-old Julian Hernandez and yet another is 11-year-old Haleigh Culwell.

Last month there was concern voiced whether the death penalties would be upheld in the cases of John Couey, and Fred Coffey, Jr.  The latest case being looked at is that of Howard Steven Ault, convicted of murdering two sisters.

(CBS4) FT. LAUDERDALE  Jury selection will begin Monday in the sentencing phase of convicted child killer Howard Steven Ault.

The jurors will decide whether to give Ault life in prison or death by lethal injection.

Howard Steven Ault was charged with two counts of first-degree murder in the deaths of two young sisters, eleven-year-old Deanne Mu’min and seven-year-old Alicia Jones. Ault was also charged with two counts of sexual battery on a child under twelve years old, two counts of kidnaping a child under thirteen years old, and two counts of aggravated child abuse

Similar to Terapon Adhahn, in Washington, he lived in Arlington, Tx. previously and was believed at one time to be connected to the murder of Amber Hagerman. Police later determined that not to be the case.

On November 4th, 1996 Ault picked the girls up at school and said if they went with him back to his place they could have candy. Two days later, Ault confessed to police that he had sexually assaulted DeAnn while Alicia watched helplessly, then strangled them both. He then told investigators where he had hidden their bodies.

There is a 6-year-old missing from Cleveland. Serena Kaviris was allegedly abducted by her mother during a supervised visit. At the NCMEC site if you click on her name you will see a  Case Type: Family Abduction but if you view the poster the heading is Endangered Missing.

NISMART–2, family abduction was defined as the taking or keeping of a child by a family member in violation of a custody order, a decree, or other legitimate custodial rights, where the taking or keeping involved some element of concealment, flight, or intent to deprive a lawful custodian indefinitely of custodial privileges.

Are you more likely to look for a child who is Endangered or with a “family member”? Why does the Case Type vary? 

Please note: NISMART 2 uses different titles than does NCMEC to categorize missing children. NCMEC’s “Endangered Missing” category corresponds to NISMART’s “Lost and Involuntarily Missing.”

The Federal Government is pursuing conspiracy charges related to dogfighting against Michael Vick. One of the interesting revelations has been that more serious charges won’t be able to be sought due to the efforts of Rep. James Sensenbrenner.

Cockfighting Ban Opposed

WASHINGTON – Rep. James Sensenbrenner, R-Menominee Falls, doesn’t have anything against animals, he just doesn’t think a law on animal fighting is a good use of federal resources.

The Animal Fighting Prohibition Act, designed to curb the growing prevalence of dog fighting and cockfighting, makes animal fighting a federal felony, punishable by up to three years in prison. Animal fighting is a misdemeanor under Federal law. The bill passed the House on Monday, 368 to 39 but faces an uncertain future in the Senate.

One of those dissenting votes was from Sensenbrenner. Rajesh Dharwani, spokesman for Sensenbrenner, said the congressman opposed the bill because he thought it would divert resources away from more serious crimes.

Perhaps those resources could be used to fulfill the promised funding and implementation of the “Adam Walsh Child Protection and Safety Protection Act of 2006″.

Or were you refering to the manpower to keep violent, mothers/grandmothers incarcerated. Maybe you could even question why Allison Quets or Mary Ann Barcaro remain in jail while Michael Vick does not. Is it because they are fighting for kids and not fighting dogs or do they just throw like girls?

Rep. James Sensenbrenner is probably better known for the “Adam Walsh Child Protection and Safety Protection Act of 2006″.

On the frontpage of the Charlotte Sun  is an update to the story of Coralrose Fullwood. She was found murdered blocks from her family’s North Port home last Sept. 17th. Unfortunately, it isn’t about her case being solved but is an update to the trial of her father Dale. He was sentenced to one year in jail and five years probation for possessing child pornography.

Police North Port, Florida Chief Terry Lewis confirmed Coralrose was sexually assaulted and violently killed too. He even raised a few eyebrows when he announced he believed no family members had “direct involvement” in the sexual assault of Coralrose.

FDLE analyzed DNA evidence was left by a male suspect. Crime-scene evidence shows more than one person was involved in the attack. Lewis said everyone is still a suspect. Her father Dale was arrested in October on two charges of possessing child pornography found on his computer but is not considered a suspect.

SARASOTA COUNTY — Dale Fullwood, the father of slain 6-year-old Coralrose Fullwood, has been sentenced to three years in prison for violating his probation on a child pornography charge.

Almost two years after 6-year-old Coralrose Fullwood was raped and slain in Southwest Florida, authorities have made an arrest. North Port police on Tuesday, Aug. 12, 2008, charged Patrick Dewayne Murphy, 27 with murder and sexual assault, based on DNA evidence.

NORTH PORT — The state requires at least a 20-day notice in case Patrick Dewayne Murphy decides to use an insanity defense in the Coralrose Fullwood murder trial.

Murphy entered a plea of not guilty when arraigned Sept. 12. The trial has been set for 9 a.m. Aug. 17, 2009, at the Sarasota County Courthouse.

During his visit to Washington D.C. one of the people Gerry McCann met with was Texas Democrat Congressman Nick Lampson. He has introduced legislation to assist in protecting children, but apparently not all his fellow legislators shared his vision. Maybe the “for other purposes” distracts from the intent.

Bring Our Children Home Act

The purpose of the bill was to amend title 28, United States Code, to give district courts of the United States jurisdiction over competing State custody determinations, and for other purposes.

This bill was proposed in a previous session of Congress. Sessions of Congress last two years, and at the end of each session all proposed bills and resolutions that haven’t passed are cleared from the books. This bill never became law.

As a member of the 110th U.S. Congress (2007-2008) he introduced these bill’s.
